According to court documents, the Nairobi lawyer solicited a Ksh10 million bribe from the former CS who filed a complaint.

The Ethics and Anti-Corruption Commission (EACC) has been cleared to continue investigating a Nairobi lawyer over allegations that he sought a Ksh10 million bribe from former Cabinet Secretary Raphael Tuju to influence a High Court judge.

The High Court in Nairobi dismissed the lawyer’s petition seeking to stop the investigation and any potential prosecution over the matter.

According to court documents obtained by Kenyans.co.ke, the judge found that the lawyer had not presented sufficient evidence to justify stopping the commission’s work.

“The Petitioner has failed to demonstrate that the EACC’s probe has crossed the high threshold of malice, clear lack of factual foundation, illegality, or ultra vires action to warrant judicial interference,” stated the judgment issued on October 7.
