Court Sets Strict Conditions for Ruto-Sakaja Nairobi Deal

The High Court has allowed the Ruto-Sakaja Nairobi deal to continue, but under strict new conditions.

The High Court has restricted the use of public funds under the cooperation agreement between President William Ruto's National Government and Nairobi Governor Johnson Sakaja's administration.

In a notice by the Katiba Institute, the court directed that no public funds should be committed, released, or spent on projects under the agreement unless authorised by Parliament or the Nairobi County Assembly.

Funds can also be provided to Nairobi County as additional allocations from the National Government in line with Article 202(2) of the Constitution.

The order was issued on September 28, 2026, after Katiba Institute challenged the constitutionality of the cooperation agreement between Nairobi County and the National Government.
